Rights of Way, Easements, Wayleaves & Additional Information
The vendor owns an adjoining parcel of 0.5 acres which he will retain a permanent Right of Way over, pending its future disposal.
This parcel of land is also considered to have development potential, given current planning policy expectations. This land is available to purchase by separate negotiation, and is shown edged blue on the site plan below
In the event that the property is sold in separate lots, the legal documentation will be structured to ensure that:
1. The purchaser of the first lot sold (which may be either Lot 1 or Lot 2) will be responsible for constructing the new access road required pursuant to the planning permission. Provision will be made requiring the access road to be completed within a timescale to be agreed between the parties (currently envisaged to be within 12 months of completion). Appropriate arrangements will also be put in place for the future repair, maintenance and renewal of the access road, with the costs to be shared between the owners of Lots 1 and 2. The seller will retain rights of way and for services over the access road for the benefit of the retained land and any future development thereof, together with appropriate step-in rights.
2. Lot 1 will require the installation of a new septic tank and will require to benefit from rights to lay, use, maintain, repair, replace and renew drainage apparatus through and over Lot 2.
3. The transfer will also contain such further rights, reservations, easements and covenants as may reasonably be required depending upon the order in which the lots are sold and the phasing of the development will be reserved or granted in the transfer documentation.
The property is sold subject to all existing rights of way, wayleaves and easements.
Access
The whole site, including the vendors' retained land, is accessed off Bartle Lane, however in accordance with planning permission 06/2024/1114, a new access is required to serve all lots.
