Permitted Payments Breaches of the tenancy agreement (default payments) From June 1st 2019 Landlords and their agents are only allowed to charge for two types of default payments - loss of keys and late payment of rent but both are subject to restrictions. For the loss of keys landlords and their agents are allowed to charge the reasonable cost and must prove it in writing with a receipt. Anything landlords cannot prove with a receipt will likely be considered a prohibited payment. For late payment of rent landlords and agents can only charge 3% above the bank of England base rate in interest on the late payment of rent from the date the payment is missed. They are not allowed to charge for sending reminder letters. Changes made by Tenants to their tenancies Circumstances change and while they sometimes cannot be avoided it does mean that a new tenancy agreement would have to be prepared because otherwise, for example if a tenant wanted to leave the tenancy they would expect to have no further obligations to it. From June 1st 2019 these changes to a tenancy can only incur a charge of £50 or less unless a reasonably higher cost is incurred by the aagent or landlord. Early Termination of a tenancy Early termination of a contract can put a landlord at a disadvantage and early termination fees can include any outstanding rent plus an additional charge from the agent. This is still one area of the Letting industry where these fees remain variable so tenants should try to avoid early termination of a tenancy if possible. Amethyst Lettings are members of The Property Ombudsman and our membership number is D5375 Amethyst Lettings are members of Client Money Protection and our membership number is CMP002505 Please note that lettings agents are required by law to publish on their websites information for potential tenants about relevant fees, redress schemes and client money protection schemes (including the names of those schemes). Relevant fees must also be published on third party websites, such as Rightmove. For properties to rent in England and Wales, details of the agent's membership of any redress scheme and client money protection scheme must also be published with their fees on Rightmove. It is the agent's responsibility to ensure that all relevant information is provided to Rightmove and is up to date and accurate. If the relevant information does not appear here, the agent may have included it within the property description.
